IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, KUNG FU CHICKEN IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE WEBSITE, OUR FOOD PRODUCTS, OR SERVICES, OUR TOTAL LIABILITY SHALL IN NO EVENT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPECIFICALLY TO KUNG FU CHICKEN (NOT THE THIRD-PARTY PLATFORM) FOR THE PARTICULAR FOOD OR SERVICE GIVING RISE TO THE CLAIM (E.G., THE VALUE OF THE INCORRECT FOOD ITEM OR CATERING SERVICE FEE), OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

THE FOREGOING LIMITATIONS DO NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (SUCH AS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT ESTABLISHED UNDER THE GOVERNING LAW). ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, IT IS PERMANENTLY BARRED.

At its sole discretion, Kung Fu Chicken may require you to submit any dispute arising from the use of these Terms or the Website, including disputes arising from or relating to their interpretation, breach, invalidity, nonperformance, or termination, to final and binding arbitration in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules, applying Florida law. The arbitration shall take place in Miami-Dade or Broward, Florida.

JURY TRIAL WAIVER: YOU AND KUNG FU CHICKEN HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHT TO SUE IN COURT AND TO A TRIAL BEFORE A JUDGE OR JURY. You and Kung Fu Chicken elect to resolve any eligible claims and disputes through arbitration.

CLASS ACTION WAIVER: ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS OR CONSOLIDATED BASIS.
